Conditions of candidates

All applicants for positions at the Higher Anti-Corruption Court were identified. Among them there are representatives of local authorities, and experienced specialists. According to the preliminary selection to the Supreme Court, one can say that some part will not pass even the “competition of documents”.

Lawyers and scientists have shown more willingness to fight the corruption.

The Japanese proverb says: “Victory goes to someone who will endure for half an hour more than the enemy”. If you approach the evaluation in terms of mathematics, then from 846 candidates who sent documents to the Supreme Qualifications Commission of the judges, about 200 were immediately eliminated. And the winners were selected only from 320 people who reached the finish line. If we apply this formula to the selection of “anti-corruption”, it turns out that out of 200 applications for participation (not included in the VACS and its appeal chamber), about a quarter will remain out of competition. So, about 160 lawyers can get admission to the competition, and after passing the tests, half of them will remain. It turns out that for one judge chair, which, we recall, only 39, will claim 2 lawyers. While after passing all stages of the pre-selection, there were three lawyers who wanted to get into it. Synchronous additional selection in the High Court also does not speak about the excitement. 406 lawyers want to complete 78 vacancies in the High Court. Thus, it can be assumed that after the beginning of trials, their number will decrease approximately to 240 and from two candidates they will choose one – with the amendment for 4 different contests to the cassation courts. But from 2016, not only the quantitative indicator of the contestants has changed. Less and less judges want to change one judicial body to another and more and more representatives of various legal occupations are interested in an honorable position.

Another school and a second attempt

If in the first competitive wave the cumulative amount of attorneys, scientists and lawyers with mixed experience did not reach 200, and therefore, about half a thousand judges tried to get a raise, the situation changed radically. Especially in the anti-corruption instance. Bearing in mind the preliminary assessment of the composition of the participants, almost half of them never carried out the justice.

Its desire to join the ranks of Themis was discovered by the bar: more than 60 defenders will try to prove themselves in the positions of judges. As promised, Eugen Grusovets, partner of “Ario” Law Firm, sent his package of documents to the Supreme Qualification Commission of Judges. Among the applicants there are also the heads of lawyer associations, who are ready to leave the positions in the companies which were created by them. Thus, Olexiy Shevchuk, Managing Partner of “Barristers”, also found his desire to fight corruption. Not all of the applicants’ files can be found.

However, under unknown surnames, there are mainly experienced contestants who already tried to move to higher judicial institutions. At one time they were eliminated from the race because of a lack of points or blocking by Public Integrity Council. The law does not prohibit such lawyers from trying their hand again, after all, as you know, defeat is a lost victory. The parallel contest in the High Court attracts attention by the fact that representatives of various state organizations are interested in it, who in one way or another is involved in the justice system. The list of candidates includes representatives of the office of the Ombudsman for Human Rights, the Prosecutor General’s Office and the Ministry of Justice. Some members of the Supreme Council of Justice – Natalia Volkovitska and Tatiana Malashenkova – also seek employment in the High Court. Probably, this is due to the fact that soon their powers in the Supreme Council of Justice will end.

Again, drawing parallels with the time it took the commission to elect the judges to the High Court, it can be assumed that a tender for an anti-corruption institution will end in February next year, as the head of the High Qualification Commission of Judges of Ukraine plans.  And the total number of participants in both competitions is not too far off than in the previous selection. Then it took almost 8 months to process the High Qualification Commission of Judges questionnaires. Although the catalyst for the process can be the presence of two organs – promoters of virtue. In addition, the Public Integrity Council already has experience in evaluating candidates for the High Court, and on the shoulders of the Public Council of International Experts will lay down some work, but it will be overwhelmed by the need to translate case files. On the displacement of the schedule may be reflected that the names of applicants in the Public Council of International Experts have not been revealed, although the deadline ended last week.  Implementation of practical tasks takes a small amount of time, which cannot be said about their verification. After all, potential judges write draft decisions that need to be analyzed in details, unlike tests. But the question of time eventually is not so critical. The main thing is that only respectable lawyers need to join the judicial bodies because they are highly expected. Even if staffed judiciary will show up after the presidential elections.
