Conflict with his ex-wife prevented the appointment of a judge

The High Council of Justice refused to appoint Yurii Melnychuk as a judge of the Uman district court of Cherkasy region because of reports of a judge’s ex-wife having been beaten and information on 17 complaints against the judge.

According to the information received by “L&B” from the press service of the department, on June 26, the High Council of Justice postponed consideration of the issue of submitting a nomination to the President of Ukraine regarding the appointment of Y. Melnychuk as a judge of the Uman district court of Cherkasy region to clarify additional circumstances.

The speaker – Igor Benedisyuk, a member of the High Council of Justice (the HCJ) noted that at the same time during the consideration of the data on nominating Y. Melnychuk to the post of judge numerous appeals were received regarding the refusal to made the nomination to the President regarding his appointment to a post of judge indefinitely in connection with interventions in the automated record-keeping system by the Uman district court of Cherkasy region, systematic violation of the rules on the disqualification (self-disqualification) of a judge, falsification of documents and unethical behavior.

Also in the HCJ was a letter from the Uman police department of the National Police General Directorate in Cherkassy region dated March 14, 2018, № 2814/49/0 / 16-2018, which concerns the recording of two appeals of S. Melnychuk, the ex-wife of the judge, to the Unified State Register of Investigations on the commission of criminal offenses , stipulated in part one of Article 125 “Deliberate infliction of light bodily injury” of the Criminal Code of Ukraine, which were closed on the basis of clause 2 of the first part of Article 284 of the CPC in connection with the absence of evidence of the commission of the offence. On April 3, 2017, the announcement of Mrs. S. Melnychuk about the illegal actions by Y. Melnychuk (infliction of bodily injury, etc.), which wasn`t entered in the Unified State Register of Investigations, was registered.

In addition, the speaker said that in the period from April 26, 2012 to September 30, 2016, to the High Qualification Commission of Judges of Ukraine received seventeen complaints against the judge which consideration resulted in a decision to refuse to open disciplinary cases, a ruling on the return of the complaint without consideration and referring it to TD of the SJA in Cherkasy region as appropriate.

According to the ruling of the HCJ dated March 29, 2018, № 2710/0/18-18, given expiry of the limitation period for the disciplinary enforcement, a complaint of Korkiyainen O. S. against the judge Y. Melnychuk was left without consideration and sent to the HQCJ of Ukraine to be added to the judge`s profile; another complaint was left without consideration and returned to the complainant, as the applicant violated the requirements of part 2 of Article 93 of the Law of Ukraine “On the Judiciary and the Status of Judges”.

Thus, the High Council of Justice has decided to refuse to submit a nomination to the President of Ukraine regarding the appointment of Y. Melnychuk as a judge of the Uman district court of Cherkasy region.
