Criminal penalty is proposed for evading objective distribution of cases in court

Criminal penalty may be introduced for breaching the principles of objectivity, impartiality, and eventuality during the distribution of cases in court.

The bill #4203 on amending the Criminal Code of Ukraine concerning the implementation of penalty for practical evasion from objective and impartial distribution of cases by the automated system of the court document flow has been registered at the Verkhovna Rada. Evgeniy Muraev, Member of Parliament from “Opposition Bloc”, is the author of this legislative initiative.

The bill proposes to supplement Article 376.1 of the Criminal Code with a new provision, which shall implement criminal penalty for violating the principles of objectivity, impartiality, and eventuality during the distribution of cases in court.

In accordance with the bill, the negligence of an official or other person, aimed at practical evasion from objective and impartial distribution of cases by the automated system of the court document flow, shall be penalized by the fine of 600 to 1000 non-taxable minimum incomes of citizens, or by restraint of freedom for a term of two to five years, or by incarceration for a term to three years, with a disqualification from holding specific offices and engaging in particular activities for a term of one to three years.
