For the second time Viktor Tatkov was dismissed from his position as a judge of the Supreme Economic Court of Ukraine by the High Council of Justice

A judge of the Supreme Economic Court of Ukraine, Viktor Tatkov, was dismissed by The High Council of Justice for committing a significant disciplinary offense.

“Law and Business” reports: “on 3d of September during a meeting of the High Council of Justice was considered the question of dismissing Tatkov from his position as a judge of the Supreme Economic Court of Ukraine on the basis of paragraph 2 of part 6 of Article 126 of the Constitution of Ukraine.”

The High Council of Justice noted that in 2016 a judge of the Supreme Economic Court of Ukraine Tatkov was dismissed from his position due to the violation of the requirements for incompatibility.

In 2017, a judge tried to appeal the decision in the Higher Administrative Court of Ukraine, and then in the Supreme Court. However, his claims were denied. But a year later, he appealed again to the Supreme Court with a lawsuit against the Verkhovna Rada, and secured the cancellation of the decision of the Verkhovna Rada on his dismissal from the position as a judge.

However, the decision of the High Council of Justice from December 24, 2015 to submit to the Verkhovna Rada a motion to dismiss Tatkov from his post as a judge of the Supreme Court of Ukraine on grounds of violation of the requirements for incompatibility continues to be valid.

It is noted that the materials and submissions of the High Council of Justice on the dismissal of judges, under the Law of Ukraine “On Amendments to the Constitution of Ukraine (on Justice)” which was not signed by the President of Ukraine or the Verkhovna Rada of Ukraine, are transmitted to the High Council of Justice for decision on dismissal of judges from the grounds stated in the submissions.

By letter from July 16, 2019, the Verkhovna Rada sent to the High Council of Justice a submission of the High Council of Justice from January 19, 2016 on the dismissal of Judge Tatkov from the position as judge on the grounds of violation of the requirements for incompatibility.

Considering the above, the High Council of Justice decided to dismiss Tatkov from the post of judge of the Supreme Court of Ukraine on the basis of paragraph 2 of part six of Article 126 of the Constitution of Ukraine.
