Ukrainian officials will be punished for slow work

Officials who too long prepare permission documents are proposed to be prosecuted. Moreover, it is not necessary that it happens through their fault.

Relevant proposals are contained in the Draft Law “On Amendments to the Criminal Code of Ukraine (concerning criminal liability for violation of the terms of administrative services’ provision, permits’ issuance” (No. 6290).

The Draft Law stipulates the addition of the Criminal Code with a new article 365-4, which introduces responsibility for violating the deadlines for the provision of administrative services, permission documents, the terms of the decision to issue a license and its cancellation. Sanctions will be applied to officials of executive authorities, authorities of the Autonomous Republic of Crimea, local self-government and some other categories of officials.

Such actions will provide for the imposition of a fine in the amount of 200 to 1,000 non-taxable minimum incomes of citizens (from UAH 3,400 to 17,000). It is also possible to apply correctional labor or even restraint up to 3 years. Even more severe sanctions will be applied if such actions entail significant damage.

At the same time, the Draft Law does not stipulate the intentional failure of officials to perform their functions. Thus, it is possible that criminal liability will be applied even in cases when a computer failure has happened or the document has not been issued through some other reasons independent of the employee.
