Every year, holidays are formed for the celebration of the New Year and Christmas, despite the postponement of working days by the Cabinet of Ministers of Ukraine. The holiday period 2019-2020 was not an exception.
The “Law and Business” reports.
It should be reminded that all holidays and religious holidays specified in Article # 73 of the Labor Code. On such days, work is not carried out at enterprises, institutions and organizations. Such holidays include New Year (January 1) and Christmas, which are two in Ukraine: Catholic on December 25 and Orthodox on January 7.
When one working day falls between the weekend (Saturday and Sunday) and public holidays, in such cases the Cabinet of Ministers usually makes such a working day a weekend, followed by working off the next Saturday “in order to create favorable conditions for the use of holidays and non-working days, as well as rational use working time.”
The postponement of business days is determined:
• in 2019 – by order of the Cabinet of Ministers dated 10.01.2019 No. 7-r;
• in 2020 – by order of the Cabinet of Ministers dated 10.23.2019 No. 995-r.
Since Catholic Christmas this year falls on Wednesday, we will have only one day off inside the week – December 25th.
But for the celebration of the New Year 2020, a four-day vacation is formed from December 29, 2019 to January 1, 2020. According to the decree No. 7-p December 30 and 31 become a weekend. We already reworked one of them on Saturday, December 21st. Another working Saturday this year is waiting for us on December 28th.
January 2 – 3, 2020 – normal working days, but for Orthodox Christmas, a four-day vacation is formed from January 4 to 7 (the working day of Monday, January 6, according to the decree No. 995-r, becomes a day off and its rework is scheduled for January 11).
It should be reminded that weekend schedules are calculated for workers with a 5-day work week. A decree on the postponement of working days is always advisory in nature. According to the Labor Code, the final decision on the transfer of days off and working days at the enterprise is made by the owner or the body (head) of the enterprise authorized by him by issuing an order or other administrative document.
